2. Our policies and your rights
The following policies provide further information and form part of the terms applicable to your purchase:
- Returns and Refunds Policy
- Shipping and Delivery Policy
- Product Safety & Care Guidelines, where relevant to the products ordered.
- Our Privacy Policy explains how personal information is handled.
Nothing in these terms or our policies excludes or restricts rights or liabilities that cannot lawfully be excluded or restricted. If any provision conflicts with your mandatory legal rights, those rights take precedence.
3. Customers and eligibility
You must be at least 18 years old to place an order.
Our specialist training aids are intended for use by adult professional instructors in teaching and demonstrations, as described on the relevant product pages.
If you order on behalf of a school, company or other organisation, you confirm that you have authority to enter into the purchase on its behalf.
We supply both business customers and, where applicable, consumers. Your legal status depends on the circumstances and purpose of the purchase. A statement made at checkout does not remove any consumer rights you otherwise have.
4. Products and descriptions
The main characteristics, contents and available options for each product are described on its product page.
Images are illustrative. Screen settings may affect how colours appear. Any stated approximate dimensions or manufacturing variations will be identified in the product description.
These qualifications do not affect our obligations to supply goods that conform to the contract, including applicable requirements concerning description, quality and fitness for purpose.
We may update listings or discontinue products for future orders. We will not materially change an accepted order without your agreement.
5. Product safety and intended use
Relevant products contain small parts and strong magnets. These present choking and ingestion hazards, including where magnets remain enclosed inside a component.
Read the warnings on the product page, the instructions supplied with the product and our Product Safety & Care Guidelines before use.
Our magnetic training aids are intended for demonstration and handling by adult professional instructors only. They are not intended for childrenβs play. Keep all components securely out of the reach of children and pets.
Follow the applicable use, inspection, care and storage instructions. Stop using any item that is cracked, damaged or has a loose or exposed magnet, and contact us for advice.
These aids are for teaching and demonstration. They are not navigational instruments, safety equipment or a substitute for current official navigation information.
If you suspect someone has swallowed a magnet or magnetic component, seek emergency medical attention immediately. Do not wait for symptoms.
Any safety acknowledgement at checkout records your acknowledgement of the instructions. It does not waive statutory rights or remove our responsibilities for product safety.
6. Placing an order and contract formation
Please check your selected products, quantities, delivery address and other details before submitting your order.
Submitting an order is an offer to purchase. Our automated order acknowledgement confirms receipt of your order and does not, by itself, constitute acceptance.
We accept your order when we send a dispatch confirmation, unless we expressly confirm acceptance earlier in writing. The contract is formed at that point.
Payment may be collected before acceptance. If we cannot accept your order, we will notify you and refund any payment taken for it without undue delay.
Reasons for declining an order may include unavailable stock, an unresolved pricing error, an unsupported delivery destination or reasonable concerns about fraud or unlawful activity.
If we propose a material change to your order, we will seek your agreement. We will not substitute a different product without your consent.
7. Prices and payment
Prices are displayed in the currency selected on our website. Consumer prices include applicable taxes that we are required to include.
Delivery charges and any other charges payable to us will be shown before you submit your order. Separate import charges may apply to international deliveries, as explained in our Shipping and Delivery Policy.
We may change prices for future orders. We will not increase the agreed price of an accepted order without your express agreement.
If we discover a pricing error before accepting your order, we will contact you to confirm the correct price or offer cancellation and a refund. We will not charge a higher price without your agreement.
You must provide accurate billing information and use a payment method you are authorised to use. Available payment methods are shown at checkout.
8. Delivery
Delivery destinations, services, charges and estimated times are explained in our Shipping and Delivery Policy.
For UK consumer orders, unless we agree another delivery period, we will deliver without undue delay and within 30 days after the contract is formed.
Where we arrange delivery using a service we offer, goods remain at our risk until they come into your physical possession or that of a person you identify to receive them.
A different statutory rule may apply if you independently commission a carrier that we did not offer.
For business orders, we also remain responsible for loss or damage during delivery arranged by us until the goods are delivered to the agreed recipient, unless we expressly agree different lawful terms in writing before purchase.
If your order is delayed, missing or damaged, contact us. Carrier investigations and insurance limits do not override your applicable rights against us.
9. Cancellations and returns
Our Returns and Refunds Policy explains statutory cancellation rights, our additional 30-day change-of-mind offer, return arrangements and refund deadlines.
UK consumers purchasing online generally have 14 days after the day of delivery to notify cancellation, followed by another 14 days to return the goods, subject to applicable exceptions.
Dispatch or acceptance of an order does not, by itself, remove statutory cancellation rights.
Any unused-condition or original-packaging requirements under our additional voluntary offer do not restrict statutory cancellation or faulty-goods rights.
Goods made to your specifications or clearly personalised may be excluded from change-of-mind cancellation where the law permits. Their faulty-goods protections remain unaffected.
10. Faulty, damaged or incorrect goods
Contact us if goods are faulty, damaged, incorrect or do not match their description.
We will provide an appropriate remedy in accordance with applicable law and our Returns and Refunds Policy. Depending on the circumstances, this may include a repair, replacement, price reduction or refund.
Consumer rights are not limited to the duration of any voluntary guarantee or warranty.
Where required by law, we will meet reasonable return costs or arrange collection. Do not continue using a product that may be unsafe.
11. Professional use and intellectual property
You may use purchased training aids for their intended teaching and demonstration purposes, including paid professional instruction.
Copyright, design rights, trademarks and other intellectual property in our original products and website materials remain with their respective owners.
Purchasing a product does not grant permission to reproduce its protected design for manufacture, resale or distribution, except where permitted by law or expressly authorised by the rights holder.
You may view our website and save or print your order information, policies and instructions for legitimate purchasing, recordkeeping and product-use purposes.
12. Website use and accounts
You must not use our website to commit fraud, infringe rights, upload malicious code, interfere with security or otherwise act unlawfully.
If you create an account, take reasonable steps to keep your login details secure and contact us if you suspect unauthorised access.
We may restrict access where reasonably necessary to address misuse, security risks or legal requirements. We will provide notice where reasonably practicable.
Restricting website or account access does not remove your rights concerning existing purchases, refunds or complaints.
We take reasonable care in operating the website, but cannot promise uninterrupted availability. This does not reduce our obligations under accepted orders.
13. Reviews and feedback
If you submit a review or other content specifically for publication, you retain ownership of your content and give us permission to display and reproduce it for relevant product information and promotion.
We will not materially alter a reviewβs meaning. We may remove content on reasonable grounds, including unlawful material, personal information, spam or content unrelated to the product or service.
This permission does not treat private customer-service correspondence or confidential material as content submitted for publication.
Our handling of personal information remains subject to our Privacy Policy and applicable law.
14. Shopify and third-party services
Our store is hosted by Shopify, which provides the ecommerce platform. Your contract for goods purchased from this store is with the legal seller identified in section 1.
Shopify collects and processes customer personal information to provide and improve its services, including enhanced services where enabled. Information submitted to the store may be shared with Shopify and service providers in other countries.
See our Privacy Policy, Shopifyβs Privacy Policy and Shopifyβs Privacy Portal for further information and available privacy choices.
Our website may link to independent third-party websites. Their services are subject to their own terms and privacy information. Such links do not remove our responsibilities for our own conduct or your purchase from us.
15. Our responsibility for loss or damage
Nothing in these terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Liability for defective products that cannot lawfully be excluded.
- Breach of statutory rights that cannot lawfully be excluded.
- Any other liability that cannot lawfully be excluded or restricted.
- If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence or was contemplated by both parties when the contract was made.
If you purchase for business purposes, liability is determined by applicable law and any valid, separately agreed written terms. These website terms do not impose a general financial liability cap or require you to indemnify us for all claims.
Failure to follow safety instructions does not automatically remove your legal rights. Responsibility for any resulting loss will depend on the circumstances and applicable law.
16. Events outside our reasonable control
If an event outside our reasonable control affects an order, we will take reasonable steps to reduce its impact and contact you about material delays.
This does not remove applicable cancellation, delivery or refund rights. We will not require you to wait indefinitely for an order.
17. Complaints
Email help@3dimensionalstudio.co.uk with your order number, a description of the issue and the outcome you are seeking.
We will investigate and respond within a reasonable time. Where further investigation is needed, we will explain the next steps.
This complaints process does not prevent you from exercising legal rights or seeking independent advice.
18. Changes to these terms
We may update these terms for future purchases and website use. The updated version and date will be published here.
An accepted order remains subject to the terms applicable when its contract was formed, unless you expressly agree to a change or a change is required by law.
19. Other important terms
If a provision is found unlawful or unenforceable, the remaining provisions continue to apply where legally possible.
A delay in exercising a right does not, by itself, mean that right has been waived.
If we transfer our obligations to another business, we will ensure the transfer does not reduce your contractual or statutory protections and will notify you where required.
Nothing in these terms excludes liability for fraud or overrides information, promises or rights that legally form part of your contract.
20. Governing law and courts
These terms are governed by the law ofΒ ENGLAND AND WALES.
For consumers, this choice does not remove mandatory protections applicable in their country of habitual residence. Consumers may bring proceedings in any courts available to them under applicable law.
FFor business customers, disputes are subject to the courts of England and Wales, unless we agree otherwise in writing.
